1. Acceptance of Terms
By accessing or using WhatListing.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
WhatListing.com is a platform that allows users to create and share property and vehicle listings. The Service provides tools for formatting listings with text, emojis, and images, and generates shareable links to these listings.
3. User Accounts
3.1. You may be required to create an account to access certain features of the Service.
3.2. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.3. You agree to provide accurate and complete information when creating an account and to update your information to keep it accurate and complete.
4. User Content
4.1. You retain ownership of any content you submit to the Service, including text, images, and other materials ("User Content").
4.2. By submitting User Content, you grant WhatListing.com a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and promoting the Service.
4.3. You are solely responsible for your User Content and the consequences of posting or publishing it.
4.4. You represent and warrant that:
a. You own or have the necessary rights to use and authorize WhatListing.com to use your User Content;
b. Your User Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person or entity;
c. Your User Content does not contain any material that is false, defamatory, misleading, or otherwise illegal.
5. Prohibited Content and Conduct
You agree not to use the Service to:
5.1. Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
5.2. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
5.3. Post or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or any other form of solicitation;
5.4. Post or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware;
5.5. Interfere with or disrupt the Service or servers or networks connected to the Service;
5.6. Violate any applicable local, state, national, or international law.
6. Listing Content Guidelines
6.1. All property and vehicle listings must contain accurate and truthful information.
6.2. Listings must not contain misleading information about the property or vehicle being listed.
6.3. Images used in listings must accurately represent the property or vehicle being listed.
6.4. WhatListing.com reserves the right to remove any listing that violates these guidelines or is otherwise inappropriate.
7. Intellectual Property
7.1. The Service and its original content, features, and functionality are owned by WhatListing.com and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7.2. You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:
a. Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials;
b. You may store files that are automatically cached by your Web browser for display enhancement purposes;
c. If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
8. Disclaimer of Warranties
8.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. WhatListing.com expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2. WhatListing.com makes no warranty that:
a. The Service will meet your requirements;
b. The Service will be uninterrupted, timely, secure, or error-free;
c. The results that may be obtained from the use of the Service will be accurate or reliable;
d. The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
9. Limitation of Liability
9.1. In no event shall WhatListing.com, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
a. Your access to or use of or inability to access or use the Service;
b. Any conduct or content of any third party on the Service;
c. Any content obtained from the Service;
d. Unauthorized access, use, or alteration of your transmissions or content;
e. Any transaction or communication between users of the Service.
10. Indemnification
You agree to defend, indemnify, and hold harmless WhatListing.com, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees ( claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.
11. Termination
11.1. WhatListing.com may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
11.2. If you wish to terminate your account, you may simply discontinue using the Service.
11.3. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
13. Changes to Terms
13.1. WhatListing.com reserves the right, at our sole discretion, to modify or replace these Terms at any time.
13.2. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
13.3. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
